株式会社ケーエス工業は、令和６年５月に請負契約を締結した、神奈川県内における民間発注工事において、建設業法第３条第１項の規定に違反して、管工事業と鉄筋工事業の許可を取得する前に、建設業法施行令第１条の２に規定する軽微な建設工事の範囲を超えて当該業種の工事を請け負った。また、建設業法第26条第３項に違反して、技術者の専任を要する建設工事であるにもかかわらず、営業所の専任技術者を本件工事の主任技術者として配置していた。 このことは、建設業法第28条第１項第２号に該当する。
