当該建設業者は、注文者として、建物６階バルコニー端部が高さ14.7メートルで請負人の労働者に危険を及ぼすおそれがあり、手すり等を設けるのが困難でなかったのに、これを設けず、もって建設物等について、請負人の労働者の労働災害を防止するため必要な措置を講じなかった。 このことで、当該建設業者の取締役は、労働安全衛生法（昭和47年法律第57号）違反により、罰金10万円の刑に処せられ、令和６年１月23日にその刑が確定し、当該建設業者は、同法違反により、罰金10万円の刑に処せられ、同月５日にその刑が確定した。
