被処分者は、令和４年５月に締結された定期建物賃貸借契約の媒介業務において、以下の宅地建物取引業法違反があった。 ①本物件が既に差し押さえられ、競落人に所有権が移転していたにもかかわらず、重要事項説明書に、その旨を記載して説明しなかった。 ②重要事項説明書に、水防法施行規則第１１条第１号の規定により市町村の長が提供する図面（水害ハザードマップ）における本物件の所在地について記載して説明しなかった。 これらのことは、①は宅地建物取引業法第３５条第１項第１号に、②は同項第１４号イ及び宅地建物取引業法施行規則第１６条の４の３第３号の２に、それぞれ違反する。
