On April 26, 2021, Daitoku Construction Co., Ltd., as the prime contractor, conducted emergency repair work on the skylight at Kanamachi Health Center, 4-chome, Kanamachi, Katsushika-ku, Tokyo. 令和３年４月26日、株式会社大徳工務店が元請事業者として行った東京都葛飾区金町四丁目18番19号の金町保健センタートップライト緊急修繕工事において、下請事業者の作業員が足場３層目(高さ6.3メートル)の端で天窓への養生作業を行っていたところ、足場の端にある開口部(幅最大で46センチメートル)から墜落し、意識不明の重体になった。災害発生原因は、開口部に手すりや中さん等を設けていなかったことである。 以上のことが、労働安全衛生法第31条第１項、労働安全衛生規則（昭和47年労働省令第32号）第655条第１項に違反し、株式会社大徳工務店及び同社代表取締役が罰金刑に処せられた。 このことが、法第28条第１項第３号に該当する。
