On April 26, 2021, Daitoku Construction Co., Ltd., as the prime contractor, conducted emergency repair work on the skylight at Kanamachi Health Center, 4-chome, Kanamachi, Katsushika-ku, Tokyo. During the work, a subcontractor worker performing protective covering at the edge of the third scaffold level (6.3 meters high) fell from an opening (up to 46 centimeters wide) at the edge of the scaffold and was found unconscious with serious injuries. 令和3年4月26日、株式会社大徳工務店が元請事業者として行った東京都葛飾区金町四丁目18番19号の金町保健センタートップライト緊急修繕工事において、下請事業者の作業員が足場3層目(高さ6.3メートル)の端で天窓への養生作業を行っていたところ、足場の端にある開口部(幅最大で46センチメートル)から墜落し、意識不明の重体になった。災害発生原因は、開口部に手すりや中さん等を設けていなかったことである。 以上のことが、労働安全衛生法第31条第1項、労働安全衛生規則(昭和47年労働省令第32号)第655条第1項に違反し、株式会社大徳工務店及び同社代表取締役が罰金刑に処せられた。 このことが、法第28条第1項第3号に該当する。
