株式会社祐伸建設の発行済株式総数の１００分の５以上の株式を有する株主が、法定の除外理由がないのに、令和元年１０月２日午前１０時頃、千葉県旭市入野字西１１０３番１株式会社祐伸建設敷地内において、廃棄物である木くず約９９．７キログラムを焼却したものである。 当該事実に基づき、佐原簡易裁判所から令和２年４月７日付け令和２年（い） 第４号略式命令において、廃棄物の処理及び清掃に関する法律違反により、発行済株式総数の１００分の５以上の株式を有する株主が罰金３０万円の刑に処せられた。 このことが、法第２８条第１項第３号及び同条第３項に該当すると認められる。
