On June 20, 2020, at a construction site in Minato City, Tokyo, the site manager of Prime Corporation used a scaffold board laid over an opening on the 6th floor, located 2.7 meters above the 5th floor, as a passageway. This violation contravened Article 31, Paragraph 1 of the Industrial Safety and Health Act and Article 654 of the Industrial Safety and Health Regulations (Ministry of Labour Ordinance No. 32 of 1972). Consequently, Prime Corporation and the site manager were subject to fines under Articles 119, Paragraph 1, and 122 of the same Act. This constitutes a violation of Article 28, Paragraph 1, Item 3 of the Construction Business Act.

令和２年６月20日、東京都港区内の工事現場において、株式会社プライムの現場代理人は、同ビル５階床面から高さ2.7メートルに位置する６階床面開口部上に敷かれた足場板を架設通路として使用させるに当たり、同通路に高さ85センチメートル以上の手すり又はこれと同等以上の機能を有する設備及び高さ35センチメートル以上50センチメートル以下の桟又はこれと同等以上の機能を有する設備を設けなければならないのに、これを設けず、もって、労働者の労働災害を防止するため必要な措置を講じなかった。 以上のことが、労働安全衛生法第31条第1項、及び労働安全衛生規則（昭和47年労働省令第32号）第654条に違反し、労働安全衛生法第119条第１項及び第122条により株式会社プライム及び現場代理人が罰金刑に処せられた。 このことが、建設業法第28条第１項第３号に該当する。
