当該建設業者は、建設業法第７条第２号に規定する営業所の専任の技術者である者が、令和５年11月30日付けで当該建設業者を退職し、別の場所で事業を行っているなど、当該建設業者の営業所に常勤して専らその職務に従事しておらず、同号に掲げる許可の基準を満たさなくなった。 当該建設業者は、建設業法第７条第１号及び建設業法施行規則第７条第１号の規定に基づく経営業務の管理責任者である者が、令和５年11月14日に当該建設業者の取締役に就任したものの、同日からしばらくの間、当該建設業者の本店に出勤しないなど、当該建設業者の常勤の役員として職務に従事しておらず、同法第７条第１号に掲げる許可の基準を満たさなくなった。
