株式会社響の代表取締役は、令和５年４月５日、静岡県御殿場市所在の同社木材置き場敷地内において、労働者Ａに、つり上げ荷重2.93トンの移動式クレーンを用いて丸太を荷台から下ろす作業を行わせるに当たり、同人が移動式クレーン運転士免許を受けず、かつ、小型移動式クレーン運転技能講習を修了していないのに、同人をつり上げ荷重が１トン以上の前記移動式クレーンの運転の業務に就かせた。 また、同社の社員は、前記移動式クレーンを用いて前記作業を行うに当たり、移動式クレーンの転倒等による労働者の危険を防止するため、あらかじめ、移動式クレーンによる作業の方法、移動式クレーンの転倒を防止するための方法並びに移動式クレーンによる作業に係る労働者の配置及び指揮の系統を定めなければならないのに、これを定めずに前記作業を行い、もって機械等による危険を防止するための必要な措置を講じなかった。 このことにより、同社、同社の代表取締役及び同社の社員に対し、労働安全衛生法違反で罰金20万円の罰金刑が確定した（沼津簡易裁判所 令和６年３月21日略式命令）。 このことは、法第28条第１項第３号に該当する。
