令和４年５月６日、株式会社大野組が元請として施工する現場（羽島市正木町須賀本村地内）において、建設機械（ローラー）のオペレーターが運転席から離れる際、原動機を止め、かつ、走行ブレーキをかける等の逸走防止措置を講じさせなかったため、車両前方にいた作業員が轢かれ、死亡する労働災害が発生した。 本事故に関し、令和５年５月３日に岐阜簡易裁判所から違反業者に対し、罰金20万円、違反行為者に対し、罰金30万円の判決が確定した。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
