株式会社ヨシダ設備は令和５年11月30日付けの建設業許可の更新申請において、役員が大麻取締法違反の罪により、平成27年５月２日付けで懲役１年（執行猶予３年）の刑が確定し、平成29年12月５日付けで当該執行猶予が取り消され、令和２年１月３日付けでその刑の執行を終えていたにもかかわらず、欠格要件に該当しない旨の誓約書（様式第６号）及び当該役員が賞罰を受けていない旨を記載した許可申請者（法人の役員等）の住所、生年月日等に関する調書（様式第12号）を提出し、もって不正の手段により令和６年２月13日付けで建設業法第３条第１項の許可を受けた。 このことは、建設業法第29条第１項第７号に該当し、同項の規定に基づき許可の取消処分の対象となる。
