林工業株式会社は、令和４年５月 16 日に札幌市中央区の工事現場で、作業員に高さが 31.49ｍあるマンションの屋上を作業床として使用させて防水工事を行わせるにあたり、同屋上は墜落により作業員に危険を及ぼすおそれがあり、同屋上に囲い等を設けることが困難ではなかったので、同屋上の周囲の端に囲い等を設けなければならなかったのに、これを設けることなく工事を行わせ、もって作業員が墜落するおそれのある場所に係る危険を防止するための必要な措置を講じなかったものである。 このことにより、労働安全衛生法第 21条第２項及び労働安全衛生規則第519条第１項に基づき、札幌簡易裁判所において、同法人及び同法人役員が罰金刑に処せられ、刑が確定した。 このことは、建設業法第２８条第１項第３号に該当するものである。
