株式会社今井緑化総業は、土木工事業を営む事業者である。同社の従業員であるＡは、同社が請け負った茅野市豊平上古田の令和３年度大日影川右岸改修工事の現場代理人として、同工事の作業員の安全管理等を行うものである。Ａは、令和４年１月17日、同社の業務に関し、法定の除外事由がないにも関わらず、同工事に伴う仮設通路造成現場において、車両系建設機械であるドラグ・ショベルを使用し鋼板の敷設作業を行うに当たり、労働者Ｂに同ドラグ・ショベルのクレーン機能を使用せず、鋼板をつり上げ、運搬させるなど、同ドラグ・ショベルをその主たる用途以外の用途に使用させ、もって機械による危険を防止するため必要な措置を講じなかった。 このことにより、株式会社今井緑化総業及び従業員Ａは労働安全衛生法違反により各々罰金20万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
