当該建設業者は、大阪市の発注する建設工事の請負契約に係る一般競争入札において、日建保全工業株式会社及び株式会社ジィテックとともに、西進建設株式会社に依頼して工事費内訳書を同社に作成させ、同社に入札を代行させ、及び入札前にこれに関連する情報を他社と交換し、これらのことにより大阪市競争入札参加者心得第４条第２号の「他の入札参加者と入札意思、入札価格（入札保証金の金額を含む。）又は入札書、工事費内訳書その他大阪市に提出する書類（以下「入札書等」という。）についていかなる相談も行わず、独自に入札価格を定めなければならない。」及び同条第３号の「落札者の決定前に、他の入札参加者に対して入札意思、入札価格（入札保証金の金額を含む。）、入札書等を意図的に開示してはならない。」との規定に違反するなど、公共工事の入札及び契約手続について不正行為等を行った。
