山梨県内の建築物（１物件）について、株式会社土谷設計事務所（山梨県知事登録（梨）第 1-04395 号）の業務に関し、設計者として、以下の一～三に掲げる規定に違反する設計を行った。 一 建築基準法（昭和 25年法律第 201号。以下「法」という。）第 35条及び建築基準法施行令（昭和 25 年政令第 338 号。以下「令」という。）第 126 条の 2第 1 項の規定に違反する設計（本件建築物について、法別表第一（い）欄（二）項に掲げる用途に供する特殊建築物で延べ面積が 500 平方メートルを超えるものに該当し、かつ、本件建築物の医務室について、令第 116 条の 2 第 1 項第 2号に該当する窓その他の開口部を有しない居室に該当するにもかかわらず、本件建築物の医務室に排煙設備を設けない設計）を行った。 二 法第 35条及び令第 126条の 4の規定に違反する設計（本件建築物の保育室について、法別表第一（い）欄（二）項に掲げる用途に供する特殊建築物の居室で照明装置の設置を通常要する部分に該当するにもかかわらず、非常用の照明装置を設けない設計）を行った。 三 法第 36条に基づく令第 114条第 5項の規定に違反する設計（本件建築物の防火上主要な準耐火構造である間仕切壁を換気の設備の風道が貫通する部分又はこれに近接する部分に、令第 114 条第 5 項により読み替える令第 112 条第21 項に規定する防火設備を設けなければならないにもかかわらず、これを設けない設計）を行った。
