有限会社函館仮設は、令和５年６月３日に北斗市浜分小学校体育館屋根改修工事において、労働者に高さ12.8メートルの体育館屋上で作業させる際、要求性能墜落防止用具を使用させる等して墜落防止の措置を講じていなかったため、結果として労働者が墜落し、負傷する労働災害が発生した。 このことにより、令和６年４月23日に函館簡易裁判所において労働安全衛生法違反として法人に対し罰金20万円の判決を受け刑が確定した。 このことは、建設業法第28条第１項第３号に該当すると認められる。
