On June 9, 2021, Asahi Zoen Co., Ltd. was involved in an incident during construction work in Totsuka Ward, Yokohama City, Kanagawa Prefecture, where workers of the primary subcontractor were transported in the basket of a boom lift to perform tree felling. The basket approached nearby power lines, resulting in two workers inside being electrocuted and dying. The company failed to establish a work plan that specified the method of work suitable for the location and the type and capacity of the boom lift used, as well as to appoint a supervisor to monitor the work when there was a risk of contact with power lines, as required by the Industrial Safety and Health Act. These violations of Article 20, Items 1 and 3 of the Act, and Article 194-9, Paragraph 1, and Article 349, Item 4 of the Industrial Safety and Health Regulations (Government Ordinance No. 32 of 1972), led to fines imposed on Asahi Zoen Co., Ltd. and its directors. The incident also constitutes a violation of Article 28, Paragraph 1, Item 3 of the Construction Business Act.

令和３年６月９日、朝日造園株式会社は神奈川県横浜市戸塚区内の工事において、高所作業車のバスケットに第一次下請事業者の労働者等を搭乗させ立木の伐採作業を行わせていたところ、高所作業車のバスケットが近くにあった送電線に接近し、バスケット内にいた労働者２名が感電死した。 同社は、高所作業車を用いて作業を行う際に、①あらかじめ当該作業に係る場所の状況、使用する高所作業車の種類及び能力等に適応する高所作業車による作業の方法が示された作業計画を定めること、②労働者が作業中に、送電線に身体等が接近することにより感電の危険が生ずるおそれのあるときは、監視人を置き、作業を監視させることが労働安全衛生法で義務付けられていたが、このような措置が講じられてなかった。 以上のことが、労働安全衛生法第20条第１号、同第３号、労働安全衛生規則(昭和47年政令32号)第194条の９第１項、第349条第４号に違反し、朝日造園株式会社及び同社取締役が罰金刑に処せられた。 このことが、建設業法第28条第１項第３号に該当する。
