上記名宛人は、上記名宛人の業務に関し、労働安全衛生法（昭和47年法律第57号。以下「安衛法」という。）第21条第２項の規定に違反したとして、令和４年９月８日に水戸簡易裁判所から罰金30万円の略式命令を受け、同月30日、当該略式命令が確定した。 なお、上記名宛人の従業員は、上記名宛人の業務に関し、安衛法第21条第２項の規定に違反したとして、また、業務上の注意義務を怠って上記名宛人の労働者に作業を行わせた過失により当該労働者を死亡させたことが刑法（明治40年法律第45号）第211条前段に規定する業務上過失致死の罪に当たるとして、令和４年９月８日に水戸簡易裁判所から罰金30万円の略式命令を受け、同月29日、当該略式命令が確定した。 これらのことは、法第28条第１項第３号に該当する。
