有限会社外谷建設は、令和３年５月31日を審査基準日とする経営事項審査において、除雪業務の売上高を土木一式工事の完成工事高に含める虚偽の記載をした申請を行い、審査結果を得た。この結果を用いて長野県及び信濃町に対して入札参加資格申請を行い、令和４・５・６年度建設工事入札参加資格を得た。 また、令和４年５月31日を審査基準日とする経営事項審査において、同様に虚偽の記載をした申請を行い、経営事項審査結果を得た。この結果を用いてインターネット一元受付により国土交通省等に対して入札参加資格申請を行い、令和５・６年度建設工事入札参加資格を得た。 このことは、建設業法第28条第１項第２号に該当する。
