有限会社伊藤建材の取締役が、法定の除外事由がないのに、令和４年６月１５日午後１時頃から同日午後４時頃までの間、同社敷地内において、廃棄物である廃材約１２立方メートルを焼却したものである。 当該事実に基づき、千葉簡易裁判所から令和５年４月１８日付け令和５年（い）第３０２７６号略式命令において、廃棄物の処理及び清掃に関する法律違反により、取締役が罰金７０万円の刑に処せられた。 このことが、法第２８条第１項第３号及び同条第３項に該当すると認められる。
