神郷建設株式会社は、令和５年８月２日、岡山県新見市の市道において、厚生労働省令で定める特定自主検査を実施していない同社所有のフォークリフトを、会社倉庫から工事現場に向かって作業員に運転させ、横転した当該フォークリフトの下敷きになり作業員が死亡する事故を起こした。 このことにより、新見簡易裁判所から同社及び同社の代表取締役が、労働安全衛生法違反等による罰金刑の略式命令を受け、いずれもその刑が確定している。 このことは、建設業法第２８条第１項第３号に該当すると認められる.
