当該建設業者の社長（ただし、取締役と登記されていない。）として、工事を統括掌理し、官公庁に対する各種報告等の業務を担当する者Aが、同社の業務に関し、令和３年７月９日午前１時頃、滋賀県大津市上田上桐生町から滋賀県大津市上田上牧町にかけて工区が所在する新名神高速道路大津ジャンクション東工事において、同社所属労働者が高所作業車の作業床から転落し、左上腕骨近位端及び左脛骨後果を骨折等の負傷をし、４日以上休業することとなったのであるから、遅滞なく、滋賀県大津市打出浜14番15号に所在する大津労働基準監督署長に対し、労働者死傷病報告を提出しなければならないのに、同年８月19日に至るまで同報告を同署長に提出せず、もって遅滞なく法令の定める報告をしなかった。このことで、当該建設業者及び同社の社長Aは、労働安全衛生法（昭和47年法律第57号）違反により、それぞれ罰金20万円の刑に処せられ、令和５年１月11日にその刑が確定した。
