当該建設業者は、茨木市内の民間発注工事（以下「本件工事」という。）において、その主たる部分である建築一式工事を株式会社ダイマツに請け負わせ、建設業の許可を受けていないガスト住研の代表者が株式会社ダイマツと直接的かつ恒常的な雇用関係がないにもかかわらず同社の主任技術者となるなど工事全体における法令順守及び職務遂行の確認を十分に行わず、建設業法第26条第３項及び第15条第２号の規定に違反して同号に規定する当該建設業者の営業所における専任の技術者を、専任を要する監理技術者として工事現場に配置するなど適格な技術者を配置しないで、本件工事において、同法第22条第１項の規定に違反して、その請け負った建設工事を一括して株式会社ダイマツに請け負わせた。 また、当該建設業者は、本件工事において、建設業法第24条の８第１項及び第４項の規定に違反して、施工体制台帳の一部及び施工体系図を作成しなかった。
