当該建設業者は、令和６年６月20日に提出した建設業法第５条の許可申請書及び第６条の書類において、同法第７条第１号及び建設業法施行規則第７条第１号の規定に基づく経営業務の管理責任者について、当該建設業者の代表取締役が、A社では、令和４年から「工事主任」であって、６年以上経営業務の管理責任者に準ずる地位にあたる者ではなく、建設業に関する建設工事の施工に必要とされる資金の調達、技術者・技能者の配置、契約の締結等の経営業務全般にも従事しておらず、しかも、同社がその同人の経験を証明していないにもかかわらず、同人が建設業法施行規則第７条第１号イ（３）に該当する者であり、同人が同社の「工事主任」として同号イ（３）に掲げる経験があることを同社が証明したとの虚偽の記載をし、同年７月19日に同法第３条第１項の建設業の許可を受けた。
