株式会社清丸の代表取締役は、法定の除外事由がないのに、令和３年７月３１日午後６時頃から同年８月１日午前７時１０分頃までの間、同社敷地内において、産業廃棄物である木くず及び一般廃棄物である衣類等合計約１１７.８キログラムを焼却したものである。 当該事実に基づき、佐原簡易裁判所から令和４年６月２１日付け令和４年（い）第２０号略式命令において、廃棄物の処理及び清掃に関する法律違反により、法人が罰金１００万円、同社代表取締役が罰金５０万円の刑に処せられた。 このことが、法第２８条第１項第３号及び同条第３項に該当すると認められる。
