株式会社塚谷建設（以下、「塚谷建設」という。）の役員は、坂井市元職員から、塚谷建設と同市との間で締結した令和３年度の除雪作業委託契約に関し、除雪作業委託料を増額する旨申し向けられるなどの取り計らいを受けていたところ、同市元職員に対し、今後も同様に塚谷建設の事業等にとって好意ある取り計らいを受けたいとの趣旨の下に、ギフトカード３６０枚（額面合計３６万円）を供与し、もって同市元職員の職務に関して賄賂を供与したとして、贈賄罪で福井簡易裁判所より罰金刑の略式命令を受け、その刑が確定している。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
