大曽根工業株式会社は、東京都内の複数の公共工事において、建設業法第22条第１項に違反して、自らが請け負った工事を一括して下請業者に請け負わせた。 また、別の東京都内の複数の公共工事において、建設業法第24条の８第１項及び第４項に規定する施工体制台帳及び施工体系図について、事実と異なる施工体制台帳及び施工体系図を作成し、その写しを発注者に提出した。 これらのことが、建設業法第28条第３項に該当する。
