株式会社大垣重興は、令和3年6月18日、天塩郡遠別町字北浜95番地9の特定環境保全公共下水道雨水管渠布設工事21工区において、労働者4名で、つり上げ荷重2.9トンの移動式クレーンを用いて鉄板の移動を行っていたところ、作業員1名が死亡する事故を発生させた。 その際、移動式クレーンの運転について、合図を行う者が合図を行うことなく作業を行い、機械等による労働者の危険を防止するための必要な措置を講じなかった。 このことにより、労働安全衛生法第20条第1号の規定に違反として、天塩簡易裁判所から罰金の略式命令を受け、令和4年9月1日に刑が確定した。 このことは、建設業法第28条第1項第3号に該当するものである。
