当該建設業者は、大阪市の発注する公共工事の請負契約に係る一般競争入札において、当該建設業者のICカードの名義人ではない行政書士（株式会社大松土建の入札担当者と同一人物）の依頼により当該建設業者のICカードを同人に預け、当該建設業者の入札について、工事費内訳書の作成と併せて電子入札に係るシステム入力による入札書の提出が行われていた。株式会社大松土建の入札担当者と同一人物にICカードを預けるなどの行為は、入札の公正を害し、有資格者としてふさわしくない行為であったとして、このことにより、当該建設業者は、同市より、令和３年12月１日から翌年２月末日までの３か月の入札参加停止措置（大阪市入札参加停止措置要綱別表１４に該当）を受けた。
