渡辺組有限会社（以下「渡辺組」という。）の労働者は、令和元年１１月１５日、北海道川上郡標茶町内の建築工事現場で作業中、脚立から地面に墜落し、左踵骨骨折の傷害を負って４日以上休業することとなった。 労働者が労働災害により４日以上の休業をした場合、労働安全衛生規則第９７条第１項により、遅滞なく労働者死傷病報告書を所轄の釧路労働基準監督署長へ提出し報告しなければならないが、渡辺組は令和２年１１月９日に至るまで同報告書を提出せず報告を行わなかった。 このため、労働安全衛生法違反により、同法人及び同法人役員が罰金刑に処され、法人が令和３年７月３０日に、同社役員が令和３年７月２９日に、それぞれ刑が確定した。
