ヤンマーアグリジャパン株式会社が元請けとして施工した工事において、令和３年５月１５日にコンクリートポンプ車を使用させて作業を行っていた際に、労働者１名がコンクリートポンプ車のブームと型枠の間に挟まれる事故が発生した。この件について、同社及び同社の従業員は同工事現場における機械の配置に関する計画を作成しなければならなかったのに、これを作成しなかったとして令和５年３月２４日付けで労働安全衛生法違反により、岩内簡易裁判所からそれぞれ罰金刑の判決を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
