令和２年12月28日、(有)マルトモ建材及び同社の従業員２名が、共謀の上、同社の業務に関し、同社土場（高山市石浦町５丁目６番地）において、法定の除外事由がないのに、廃棄物である木くず（残焼物重量約190キログラム）を焼却したことに関し、令和３年12月24日に高山簡易裁判所から廃棄物の処理及び清掃に関する法律違反により、同社に罰金100万円及び使用人２名に罰金50万円及び40万円の略式命令を受け、その刑が確定している。 このことが、建設業法第28条第１項第３号に該当すると認められる。
