有限会社長岡造園土木代表取締役長岡清は、同会社の業務に関し、令和４年４月２２日、岐阜県高山市上宝町葛山地内の木材伐出作業現場において、同会社の労働者を使用して立木の伐木作業を行うに際し、 第一、伐倒について一定の合図を定め、当該作業に関係がある労働者に周知しなければならないのに、同合図を定め、周知しておらず、第二、伐倒木が激突することによる危険を防止するため、伐倒しようとする立木を中心として、当該立木の高さの二倍に相当する距離を半径とする円形の内側に、他の労働者を立ち入らせてはならないのに、労働者を立ち入らせ、もって、伐木作業における作業方法から生ずる危険を防止するために必要な措置を講じなかったものである。令和４年１１月２５日に高山簡易裁判所から違反業者に対し、罰金２０万円、違反行為者に対し、罰金２０万円の判決を受け、刑が確定した。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
