株式会社巧栄工務店は、令和５年９月18日、山口県防府市内の寺本堂改修工事において、天井裏を作業床として労働者に作業を行わせるに当たり、労働者が墜落するおそれのある場所に係る危険を防止するため必要な措置を講じなかった。このことにより、同社及び同社の従業員が、労働安全衛生法違反により、防府簡易裁判所から、それぞれ罰金20万円の略式命令を受け、令和６年８月15日に刑が確定している。このことは、建設業法第28条第１項第３号に該当すると認められる。
