株式会社誠華の元代表取締役は，東広島市が発注した道路河川等維持業務に関し，元東広島市職員に対して，同社を立木伐採作業の下請業者として推奨するなどして，同社が立木伐採作業を下請受注できるよう有利かつ便宜な取り計らいを受けたことに対する謝礼及び今後も同様の取り計らいを受けたい趣旨の下に，現金を供与した。 このことにより，同社の元代表取締役は，広島地方裁判所から刑法第198条(贈賄)違反による懲役10か月(執行猶予３年)の判決を受け，令和４年２月９日にその刑が確定した。 このことが，建設業法第28条第１項第３号に該当する。
