株式会社綿半工務が元請として請け負った沖縄県中頭郡中城村地内の住宅解体工事現場で令和５年２月１８日、車両系建設機械が転倒し、その際にコンクリート圧砕機及びつり上げた資材が作業員に当たり死亡する事故が発生した。 この件について、労働者及び関係請負人の労働者の作業が同一の場所において行われるに当たり、すべての関係請負人が参加する協議組織の設置及び運営を行わず、作業場所の巡視を毎作業日に少なくとも１回行わなかったとして、令和６年１２月６日に沖縄簡易裁判所より同社と同社社員１名が労働安全衛生法違反で略式命令（いずれも罰金２０万円）を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
