美作建設株式会社は、令和４年１２月１９日、岡山県美作市内の伐木作業現場において、作業員に伐木作業を行わせるに当たり必要な安全措置を講じなかったために、当該作業員が倒木の下敷きになり死亡する事故を起こした。 このことにより、津山簡易裁判所から同社及び同社の代表取締役が、労働安全衛生法違反により罰金刑の略式命令を受け、いずれもその刑が確定している。 このことは、建設業法第２８条第１項第３号に該当すると認められる.
