株式会社宇徳が一次下請として請け負った鳥取県米子市における発電所建設工事において、令和2年9月１5日、二次下請作業員が足場上での作業中に、足場の横転により地上に墜落した。 この事故に関し、4日以上の休業を要する労働災害が発生したことから、遅滞なく、所轄労働基準監督署に労働者死傷病報告書を提出しなければならなかったのに、令和3年1月18日に至るまで同報告書を提出しなかったこと及びこの事故に関し、令和2年12月24日、労働基準監督官からの質問に対して虚偽の陳述をしたことについて、同社及び同社元社員1名が、令和4年1月11日、米子簡易裁判所より労働安全衛生法違反で略式命令（ それぞれ罰金20万円） を受け、その刑が確定している。 このことが、建設業法第28条第1項第3号に該当すると認められる。
