（株）茂見塗装は、令和2年6月10日、長崎県諫早市小川町の個人住宅の新築工事現場において、1次下請人として塗装工事を施工する事業者であり、同社代表取締役は、同社の業務に関し、施工管理及び安全管理を統括する者であるが、同工事で労働者らに足場上で塗装作業を行わせるにあたり、高さ3．2メートルの足場床において墜落により労働者に危険を及ぼすおそれがあり、かつ開口部に手すり等を設けることが容易であったにもかかわらず、その措置を講じず作業を行わせた結果、労働者が重篤な障害を伴う怪我を負った。 このことにより、諫早簡易裁判所より、（株）茂見塗装及び同社代表取締役は労働安全衛生法違反により、それぞれ罰金20万円の略式命令を受け、令和3年12月10日にその刑が確定した。 このことが、建設業法第２８条第１項第３号に該当し、監督処分の対象となる。
