当該建設業者は、大阪市内の民間発注工事（以下「本件工事」という。）において、発注者から直接その工事を請け負った特定建設業者以外の建設業を営む者である株式会社アップ大田と下請代金の額が建設業法第３条第１項第２号の政令で定める金額以上となる下請契約を締結した。 また、本件工事において、同社は、躯体が完成するまで、建設業法第26条第１項又は第２項の規定に違反して、当該工事現場における建設工事の施工の技術上の管理をつかさどる者を配置せず、現場作業に係る実地の総括的技術指導を行わないなど、自ら施工計画の作成、工程管理、品質管理、安全管理、技術的指導等の全ては行わずに本件工事の主たる部分である建築一式工事を当該建設業者に請け負わせており、当該建設業者は、同法第22条第２項の規定に違反して、株式会社アップ大田から同社の請け負った建設工事を一括して請け負った。 さらに、当該建設業者は、建設業法第26条第３項及び第15条第２号の規定に違反して、同号に規定する同社の営業所における専任の技術者であった者を専任を要する主任技術者として工事現場に配置し、同人が退職後においては他社の従業員である者を当該建設業者の主任技術者として工事現場に配置しており、同法第26条第１項の規定に違反して、直接的かつ恒常的な雇用関係のないために資格要件を満たさない者を主任技術者として工事現場に配置した。 加えて、本件工事において、建設業法第３条第１項の規定に違反して建具工事業に係る同項の許可を受けないで建設業を営む株式会社ティーキューブと下請契約を締結した。
