日本テクノエンジ株式会社は、秋田県秋田市内の工事ほか、工事現場の職務に従事しながら実質的に営業所の職務にも従事しうる程度には工事現場と営業所が近接していない複数の工事において、建設業法第７条第２号及び第15条第２号の規定に違反して、営業所における専任の技術者を同法第26条第１項に規定する主任技術者及び同条第２項に規定する監理技術者として工事現場に配置した。 また、埼玉県八潮市内の工事ほか、専任の主任技術者等の配置を要する複数の工事において、建設業法第26条第３項の規定に違反して、営業所における専任の技術者を監理技術者として配置した。 このことが、建設業法第28条第１項本文及び第２号に該当する。
