有限会社ハウジングかとう工務店の元役員（犯行当時取締役）は、令和５年９月２２日頃アルバイト従業員と共謀の上、同社の管理地に家屋等の解体現場から排出された石膏ボードなどの産業廃棄物約７．５トンを埋め立てて投棄し、もってみだりに廃棄物を捨てたとして、廃棄物の処理及び清掃に関する法律違反の罪により、令和７年５月７日に秋田地方裁判所能代支部において、同社は罰金２００万円、元役員は罰金５０万円と懲役２年（執行猶予３年）の判決を受け、その刑が確定した。 このことが、建設業法第２８条第３項（同条第１項第３号該当）に該当すると認められる。
