令和４年１２月２９日に岐阜県加茂郡八百津町八百津４５３０番地南方約７０メートル先、（有）丸北土木敷地内において、廃棄物であるソファー、角材等約３４キログラムを焼却したことに関し、令和５年５月２４日に御嵩簡易裁判所から廃棄物の処理及び清掃に関する法律違反により、同社代表取締役に対し、罰金30万円の略式命令を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
