株式会社西川工業は，令和２年２月26日，香川県仲多度郡多度津町内の工事現場において，足場の解体作業にあたり，当該業務に関する安全又は衛生のための特別教育をせず作業を行わせ，死亡事故が発生した。 このことにより，同社は，労働安全衛生法違反により，福山簡易裁判所から罰金20万円の略式命令を受け，令和３年３月25日にその刑が確定した。 このことが，建設業法第28条第１項第３号に該当すると認められる。
