木部建設（株）が一次下請として請け負った山形県西村山郡西川町における排水トンネル工事において、令和４年６月１１日、高所作業車が後方に逸走し、作業員1名が死亡する事故が発生した。 作業員が高所作業車を停車させて運転席から離れる場合、同車の原動機を止め、かつ、停止状態を保持するためのブレーキを確実にかける等の逸走を防止する措置を講じさせなければならないところ、作業員に同車運転席から離れる際にサイドブレーキを確実にかけさせるなどしなかったため、同車を後方に逸走させたことから、機械等による危険を防止するため必要な措置を講じなかったとして、同社及び同社社員１名が令和４年１１月１７日、山形簡易裁判所より労働安全衛生法違反で略式命令（それぞれ罰金２０万円）を受け、その刑が確定している。 このことが建設業法第２８条第１項第３号に該当すると認められる。
