ＳＵＮ建設株式会社は、令和２年３月から令和３年３月までの間、複数の民間発注のマンション新築工事において、以下の建設業法（以下「法」という）に違反する行為を行った。 (1) 法第３条第１項の規定に違反して、法施行令第１条の２第１項で定める金額以上の請負契約を締結した。 (2) 法第１６条第１項の規定に違反して、法第３条第１項第２号に規定する法施行令第２条に定める金額以上となる下請契約を締結した。 これらのことは法第２８条第１項２号及び同条第２項第２号に該当する。
