有限会社栄光建設は、門川町発注の専任が必要な建設工事の主任技術者として、営業所に常勤して専らその職務に従事しなければならない専任技術者を配置し、当該主任技術者に、当該専任が必要な建設工事の期間と重複して他の建設工事の主任技術者を兼任させた。このことが、建設業法第7条第2号及び同法第26条第3項に違反し、同法第28条第1項本文及び同項第2号に該当する。
