被処分者は、令和４年７月１９日から令和５年６月８日の間における合計１９１件の建物の賃貸借の媒介に関して、従たる事務所である板橋東口店における宅地建物取引士証の失効者に、法第３５条の規定に基づく重要事項の説明を宅地建物取引士として行わせた。 また、上記期間及び事務所において、合計１９１件の建物の賃貸借の媒介に関して、宅地建物取引士証の失効者に、法第３７条の規定に基づき交付される契約関係書面について、宅地建物取引士として記名をさせた。 さらに、上記期間及び事務所において、法第３１条の３第１項に規定する専任の宅地建物取引士を置かない状態が発生し、同項の規定に抵触するに至ったにもかかわらず、２週間以内に同項の規定に適合させるための必要な措置を執らなかった。 以上の行為は、法第３１条の３第３項、法第３５条第１項及び法第３７条第３項の規定に違反する。
