株式会社多賀組の元代表取締役は、多賀町が令和３年３月23日に入札を執行した「令和２年度（建工）第24号霜ヶ原高橋補修工事」の指名競争入札に関し、多賀町職員と共謀の上、同職員から、同入札における秘密事項である同工事の予定価格に近接した金額の教示を受け、よって、同工事の入札において、同社をして、予定価格に近接した金額で入札させて同工事を落札させ、もって偽計を用いて公の入札で契約を締結するためのものの公正を害すべき行為を行った。 これにより、株式会社多賀組の元代表取締役は、公契約関係競売入札妨害の罪により、令和３年12月23日に大津地方裁判所から、懲役１年（執行猶予３年）の判決を受け、令和４年１月７日にその刑が確定した。 このことが、建設業法第28条第１項第２号および第３号に該当すると認められる。また、滋賀県建設業者等の不正行為等に対する監督処分の基準第３の２(2)①を適用し、営業停止期間は、１年間とする。
