同社が請け負った岩手中部工業団地内第一事業区造成工事の施工にあたって、同社従業員は現場代理人として、同現場の安全管理等を統括管理する者であったが、令和４年12月８日、同現場において被災労働者を使用して明かり掘削の作業を行わせるに当たり、地山の崩壊により危険をおよぼすおそれがあったにも関わらず、当該危険を防止するための措置を講じなかったことにより、同社及び同社従業員が労働安全衛生法違反により罰金の有罪判決を受け、その刑が確定している。 このことが、建設業法第28条第１項第３号に該当すると認められる。
