当該建設業者は、茨木市内の民間発注工事（以下「本件工事」という。）において、建設業法第15条第２号に規定する営業所の専任の技術者を配置するなど適格な技術者を配置していない株式会社齋藤工務店から本件工事の主たる部分である建築一式工事を請け負っており、特に同社から工事現場等で指示を受けておらず、同法第22条第２項の規定に違反して、同社から同社が請け負った建設工事を一括して請け負った。 また、当該建設業者は、建設業法第７条第２号に規定する同社の営業所における専任の技術者を同社と株式会社齋藤工務店の現場代理人に配置するとともに、同法第26条第１項及び第３項の規定に違反して、建設業の許可を受けていないガスト住研の代表者を、専任を要する主任技術者として工事現場に配置するなど直接的かつ恒常的な雇用関係がある適格な技術者を配置しないで、その主たる部分である建築一式工事を同社に請け負わせており、同法第22条第１項の規定に違反して、その請け負った建設工事を一括して同社に請け負わせた。これと重ねて、同法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む同社と下請契約を締結した。
